As a homeowner in Montgomery County, you’re well aware of the regulations of your neighborhood association and local property and land usage laws. But were you aware that there are also regulations concerning pool construction and ownership? These regulations are easy to comply with, but of course it’s still important to take them into consideration before choosing to go ahead with your project. In this week’s blog, we’ll cover all the bases on pool regulations in Montgomery County so you know what you’re dealing with.
Pool Regulations in Montgomery County
Permits
You’ll need a permit to build a pool on your residential property. The fee for inground pools is $75.
Enclosures
Pools must be protected by enclosures both during construction and during regular use.
During construction. A swimming pool over 18 inches deep, or the property on which the pool is constructed, must be enclosed by a temporary or permanent fence or wall while the swimming pool is under construction. The fence or wall must be at least 42 inches high and must be of a type which will warn of potential danger.
The permanent enclosure must be:
at least 5 feet high;
(2) securely anchored in the ground;
(3) not easy to climb or penetrate; and
(4) maintained in good condition.
Gates
There are also a few specific regulations regarding gates that allow people to enter and exit the enclosure around your pool.
Any gate or door in a fence or wall enclosing a private swimming pool must have a self-closing and self-latching lock or latch on the pool side of the gate or door at a height of not less than 4 feet from the ground. Any gate or door must be closed and latched when the pool is not attended.
Final Inspection
After your pool has been completed but before you fill it with water, it must pass a final inspection. You can request an inspection from the Montgomery County Department of Permitting Services, which must be done within 5 days after the pool’s completion.
